By using our website or downloading our app, you confirm that you accept and agree to these Terms of Use. If you do not agree to these terms, you must not use our website or download our app.

The Sites are managed by Triumph Motorcycles Limited ("«Us»Our company registration number in England and Wales is 01735844 and our offices are located at Ashby Road, Measham, Swadlincote, Derbyshire, DE12 7JP. We grant you a license to use our app or website in accordance with these terms.

Specifically, please note that your use of the map feature in our App is subject to: (1) Google’s Privacy Policy, available at https://www.google.com/policies/privacy/; and (2) the additional terms of service for Google Maps/Google Earth, available at https://maps.google.com/help/terms_maps.html.

In case of conflict between these terms of use and the Appstore rules, the latter shall prevail.

Please refer to the relevant pages on our website, available at www.triumphmotorcycles.es/bikes/my-triumph-connectivity-system, For more information about the App, including its features and the devices on which the compatibility of the basic functions with the My Triumph connectivity module has been tested.

We grant you the personal right to use the App as described above. Therefore, you may not transfer the App to another person, whether for money, free of charge, or in any other way. If you intend to sell a device on which the App is installed, you must uninstall it first.

From time to time, we may automatically update the app and modify the services available within it to improve performance and functionality, reflect operating system changes, or address security issues. Alternatively, we may ask you to update the app for these same reasons.

If you choose not to install updates or if you do not enable automatic updates, you will not be able to continue using the App and the services available in it.

If you download the App on a phone or other device that you do not own, you must have the owner's permission to do so. You will be responsible for complying with these terms, whether or not you own the phone or device.

By using the App, you agree that we may collect and use technical information about the devices you use to use the App and related hardware, software, and peripherals to improve our products and provide you with services. License restrictions

You accept the following conditions:

  • Comply with all laws pertaining to the use of the Sites;
  • Do not rent, lease, sublicense, lend, provide or otherwise make the sites available to other people, either in part or in whole, without our written consent;
  • do not copy the Sites, except as part of normal use of the App or where necessary for backup, operational security or any other purpose set out in these terms;
  • not to translate, combine, adapt, vary, alter or modify the Sites in whole or in part, nor allow the Sites to be combined or added in whole or in part to other programs, except as necessary to use the Sites on devices as authorized in these terms;
  • Do not disassemble, decompile, reverse engineer, or create derivative products based on all or part of the Sites, or attempt any of these actions except as permitted under sections 50B and 296A of the Rights, Designs and Patents Act 1988.

Keep your account details safe.

You may view, copy, print and use the content of our Sites exclusively for your personal use and provided that the following requirements are met: (1) use is exclusively for informational and non-commercial purposes; (2) you must not modify in any way the paper copies or the digital copies you have printed; and (3) you must not use or copy any photo, video, audio sequence or graphic without the accompanying text.

Our status (and that of our identified contributors) as authors of the content on our Sites must always be acknowledged.

Safe driving

The photographs and videos used on our sites show Triumph motorcycles ridden by professional riders wearing protective gear and riding in closed, traffic-free areas under expert supervision. We do not condone or encourage stunt riding or any other form of irresponsible riding.

The motorcycles featured in our videos are street-legal models with limited off-road capabilities. Light off-road use includes riding on unpaved surfaces and dirt or gravel roads, but does not include motocross, off-road racing of any kind, or riding with a passenger. Light off-road use does not include motorcycle jumps or riding over obstacles. The stunts shown in the photos should not be attempted at home.

At Triumph, we want every journey to be safe and enjoyable. Always ride safely, prudently, and within the law. Don't ride beyond your skill level, attend riding courses, and use protective gear. Never ride under the influence of alcohol or drugs. Always wear an approved helmet, eye protection, and appropriate protective clothing, and always insist that your passenger do the same. 

Read the owner's manual and check your Triumph before you go for a ride.

Our app can be used to provide directions while riding. If you wish to use this feature, please do not use the app or the My Triumph connectivity system in a way that distracts you while riding.

You must not use any other functionality of our App or use the App for any other purpose while driving.

Never visit our website while driving.

Triumph does not accept any responsibility to you or to third parties if your driving does not comply with any of the points in this section (Safe Driving).

Our responsibility for any losses or damages you may suffer

We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors, and for fraud or fraudulent misrepresentation.

Various limitations and exclusions of liability will apply as a result of providing you with any product, in which case it will be reflected in the terms and conditions of supply that we will make known to you when you purchase products on our Sites.

We provide our Sites solely for domestic and private use. You agree not to use our Sites for any commercial or business purposes, and we do not acknowledge any liability to you for loss of profits, business interruption, or cessation of earnings.

If the digital content we have provided causes damage to a device or digital content you own, and this is due to a lack of diligence or skill on our part, we will repair the damage or compensate you financially. However, we will not be liable for damage that you could have avoided by following our advice to install a free update, or for damage caused by your failure to properly follow the installation instructions or your lack of the minimum requirements we recommended.

If we are unable to comply with these terms, we will be liable for any losses or damages you suffer as a foreseeable result of our failure to comply with these terms or our lack of due diligence and ability, but we will not be liable for any loss or damage that is not foreseeable. A loss or damage is foreseeable if it is obvious that it will occur or if, at the time you accepted these terms, we both knew it could occur. 

Territory

All information on our Sites relates to the UK market. It can be accessed from other countries, but users should be aware that some products, programs, and services may not be available in their respective countries due to technical, legislative, or market limitations.

Motorcycle and accessory specifications may vary from country to country. The specifications shown on our UK sites are for the UK market only. Please note that many countries prohibit the import, registration, and use of vehicles not specifically built to their country's specifications. Check with your local dealer for model, accessory, and apparel availability.

Security

We do not guarantee that our Sites are free from programming errors or computer viruses.

You are responsible for configuring your device, computer equipment, software, and platform to access our Sites. You must use your own antivirus protection software.

You must not misuse our Sites by knowingly introducing viruses, Trojans, worms, logic bombs, or any other malicious or technologically harmful material. You must not attempt to gain unauthorized access to our Sites, the server that hosts them, or any other server, computer, or database connected to our Sites. You must not attack our Site by means of denial-of-service attacks or distributed denial-of-service attacks. If you breach this rule, you will be committing an offense under the Fraudulent Use of Computers Act 1990. We will report such breaches to the relevant authorities and cooperate with them by providing your identity. In the event of such a breach, we will immediately terminate your right to access our Sites.

Please be aware that internet transmissions are never completely confidential or secure and that any message or information you send using the Sites may be read or intercepted by others, even if that particular transmission is encrypted.

Parts and accessories

We recommend using only genuine Triumph parts and accessories on Triumph motorcycles and that these items be installed exclusively by authorized Triumph dealers. We accept no liability whatsoever for defects caused by the installation of unauthorized parts, accessories, or conversions, or by the installation of authorized parts, accessories, or conversions performed by unauthorized personnel. The installation of unauthorized parts, accessories, or conversions, or the installation of authorized parts, accessories, or conversions not performed by an authorized Triumph dealer, may affect the handling, stability, or other aspects of the motorcycle's operation and could result in an accident with serious injury or death. More specifically, it is extremely dangerous to install or replace parts or accessories that require disassembling or tampering with the electrical or fuel system.

Ending

If we terminate your right to use the Sites:

  • You must stop all activities authorized by these terms, including the use of the Sites;
  • You must delete or remove the App from all devices in your possession, immediately destroy all copies of the App in your possession, and confirm to us that you have done so.
  • We can remotely access your devices to remove the App from them and stop providing you with access to the services available through the App.

Applicable regulations and jurisdiction

These terms of use, their subject matter, and their application (including any non-contractual claims and disputes) are governed by English law. We both agree to submit exclusively to the jurisdiction of the courts of England and Wales. If you are a resident of Northern Ireland, the courts of Northern Ireland will also have jurisdiction, and if you are a resident of Scotland, the courts of Scotland will also have jurisdiction.

Alternative dispute resolution

Alternative dispute resolution is a process in which an independent body reviews the facts of a dispute and seeks a solution without going to court.
